# Clearance — USPTO Knockout Search for LANEWORK

Scope: the record of the pre-filing clearance search — what was searched, what was found, the analysis of the one adjacent mark (WORKLANE), the registrability assessment, and the filing plan the search supports. Search tool: USPTO Trademark Search (tmsearch.uspto.gov), live database as of the dated line.

## Verdict

Clear to file. Zero exact matches for LANEWORK in any class, living or dead. No lane-formative mark anywhere in the kanban / task-management / productivity software space. One yellow flag — WORKLANE, an intent-to-use application in adjacent goods — which raises the possibility of an examiner citation and suspension but does not block filing and carries solid coexistence arguments (analysis below).

## Searches run

1. `lane*` (wordmark prefix), coordinated-class filter around Class 9, live marks: 1,597 results; first 500 exported and screened programmatically for (a) WORK-formative wordmarks and (b) goods/services touching software or productivity.
2. `CM:*lane* AND GS:("project management" OR "task management" OR kanban OR productivity OR "to-do")` (expert mode, substring + goods filter, dead marks included): 106 results, all screened — this query covers the full register for lane-formative marks in the relevant goods space, not just the first 500 of the prefix search.
3. `lanework` exact, all classes, dead marks included: **zero results**.

Known hole in query 2's keyword net: it omitted "workflow", which is why WORKLANE (goods: "business workflows") did not surface — it was found separately by manual browsing. Any future re-screen should add "workflow" and "collaboration" to the goods keywords.

## Screen results

Of the 500 exported prefix-search rows: exactly one WORK-formative (DISTILLERY LANE CIDERWORKS — hard cider, irrelevant), and eleven lane-formative marks with software goods, every one in a distant vertical: LICENSE LANE (professional-license compliance), AXESS LANE (curbside pickup logistics), SERVICE LANE EADVISOR (vehicle service appointments), L LANE (fax/EDI messaging SaaS), LEGACY LANE (family-memories app), WIND LANE (driver weather alerts), BIRCH LANE (VR room design), plus a bingo game, a lending platform, and a Singapore consulting shop. Zero hits on project-management / task-management / kanban / productivity keywords across all 500 goods descriptions.

Of the 106 goods-filtered rows: 76 were false positives (the substring matched P**LANE**T / PLANE). The genuine lane-marks in or near the space:

- **ROCKETLANE** — live, four registrations (earliest filed 2020-09-17, reg 7265560), Class 42: SaaS for project management, task management, document collaboration. A venture-backed client-onboarding / professional-services platform. Closest live mark by goods; distinguishable by mark (see crowded-field argument).
- **USERLANE** — live, reg 6564713, Classes 9/41/42: digital-adoption / training-overlay software.
- **STORMLANE** — live, reg 7669623, Classes 41/42: IT project-management consulting services.
- **MULTILANE** — pending, Classes 9/35/42: hardware-testing software.
- **DRIFTLANE** — pending ×2, Class 42: subscription creative-design services.
- **TERRALANES** — the only mark that covered downloadable project-management software in Class 9 specifically — **dead**. SWIMLANE RACI also dead. (SWIMLANE itself, the security-automation company, is registered but in a distant vertical; noted for awareness only — the product vocabulary already avoids "swimlane" per the lane-terminology ruling.)

## The WORKLANE flag

**WORKLANE, serial 99594941** — Harbr LLC d/b/a Worklane, Winter Garden, Florida. Filed 2026-01-14, Section 1(b) intent-to-use, Class 42 only: "Software as a service featuring AI-powered automation for business workflows, third-party system integration, and operational insights; online non-downloadable software for managing customer communications and operations." Prosecution was frictionless: assigned 2026-05-12, approved for publication 2026-05-15 with no §2(d) refusal, published 2026-06-09, unopposed, Notice of Allowance 2026-08-04. Statement of Use due **2027-02-04**, extendable in six-month increments to roughly 2029-08. Web presence as of the search date: a Framer template site only — early-stage.

This is a transposed mark (same two elements, reversed). Under TMEP §1207.01(b)(vii), transpositions conflict when they create the same commercial impression and coexist when the reversal changes the connotation. The coexistence argument: WORKLANE reads as "a (fast) lane for your work" — a speed metaphor; LANEWORK reads like *lacework* or *framework* — a coined craft-word for a structure made of lanes, which is literally what a kanban board is. Goods distance reinforces it: Class 42 B2B automation SaaS versus Class 9 downloadable personal Mac software, different channels, different purchasers.

Realistic scenario when the LANEWORK application is examined: a meaningful chance (~coin flip) the examiner cites WORKLANE; because it is earlier-filed and pending, the usual mechanics would suspend the LANEWORK application until WORKLANE registers or lapses. If it registers, the §2(d) refusal gets argued on transposition-connotation + goods-distance + crowded-field grounds. If the ITU lapses — a real possibility for an early-stage company with up to three years of extension runway — the cloud evaporates. Expected cost is delay, not loss of the mark. Priority note: WORKLANE's filing date already predates any LANEWORK filing, so waiting gains nothing and only risks a third lane-compound filer getting ahead.

## Registrability assessment

LANEWORK is a coined compound, suggestive at worst ("lane" hints at the product's column vocabulary without describing the software), registrable on the Principal Register without acquired distinctiveness.

The crowded-field posture is the load-bearing argument throughout: 1,597 live lane-formative marks means LANE is a heavily diluted element, and both examiners and the TTAB distinguish marks in a crowded field by their non-shared elements. ROCKETLANE, USERLANE, STORMLANE, MULTILANE, and DRIFTLANE all coexist on the register today, each distinguished by its non-LANE element — and WORKLANE itself was approved over all of them, which confirms the office treats these compounds as distinguishable. LANEWORK's "-work" is exactly such a distinguishing element.

## Filing plan

- Section 1(b) intent-to-use, standard-character word mark (not the logo — standard characters cover every styling; a logo filing can follow later if ever warranted).
- Class 9 only — the app is a local-file Mac app with no hosted service, so Class 42 is unnecessary; skip the second per-class fee.
- Identification from the Trademark ID Manual (pre-approved wording keeps the $350 base fee; free-form text adds a $200 surcharge), along the lines of: "downloadable computer software for personal task management using kanban-style boards." Deliberately keep "workflow", "automation", and "business" out of the identification — every word of distance from WORKLANE's goods helps.
- Owner: whichever entity will own the mark long-term, decided before filing — assignments of intent-to-use applications are restricted (15 U.S.C. §1060(a)(1)).
- After App Store launch: Statement of Use ($150) with the App Store listing as specimen; six months from Notice of Allowance, extendable ($125 per six-month extension) up to three years.
- Post-registration: Section 8/15 declaration in the year 5–6 window; renewal every 10 years. Expect official-looking scam solicitations from private "trademark registries" once the application publishes the mailing address — everything real comes from uspto.gov.

## Residual risk register

- WORKLANE citation → suspension → possible §2(d) argument (mitigations above; watch date 2027-02-04 in README).
- The prefix-search screen covered only the first 500 of 1,597 `lane*` rows, but query 2 covered the full register for the relevant goods space, so the residual exposure is a lane-formative mark whose goods description uses none of the screened keywords — judged low, and the examiner's own search is the backstop.
- Common-law (unregistered) uses: web searches on the date above found no software product named Lanework; the App Store, domain, and GitHub namespace sweep should be repeated once shortly before launch marketing begins.
